Evacuation Route Map App Terms of Use

Chuo University Coastal and Port Laboratory

These Terms of Use (the “Terms”) set forth the conditions governing use of the smartphone application entitled “Evacuation Route Guidance App” (the “App”), which is provided by the Chuo University Coastal and Port Laboratory (the “Laboratory”) as part of its research activities. By using the App, the user shall be deemed to have agreed to these Terms.

1.Purpose and Positioning

  1. The App is a research application intended to provide information to support users’ evacuation behavior in situations where a tsunami or other disaster has occurred or may occur.

  2. The App may display evacuation routes, evacuation sites, information relating to the area around the user’s current location, and other reference information; however, it does not guarantee any particular evacuation action, evacuation outcome, or level of safety.

  3. Users shall use the App at their own judgment and responsibility, with the understanding that the App is provided as part of research activities.

2.Conditions of Use

  1. Users shall use the App at their own responsibility.

  2. In using the App, users shall comply with applicable laws and regulations, public order and morals, and these Terms.

  3. The Laboratory grants users permission to use the App free of charge.

3.Nature of the Information Provided

  1. Map information, evacuation shelter information, evacuation route information, disaster-related information, and all other information posted or displayed in the App (collectively, the “Provided Information”) may be created on the basis of information made public by the national government, local governments, third-party service providers, and others, as well as analyses, processing, or research results produced by the Laboratory.

  2. The Laboratory makes no representations or warranties whatsoever with respect to the accuracy, completeness, currency, usefulness, fitness for a particular purpose, or any other aspect of the Provided Information.

  3. In taking actual evacuation action, users shall not rely solely on the information provided through the App and shall give highest priority to information or instructions issued by the Japan Meteorological Agency, local governments, police, fire departments, and other public authorities, as well as to local conditions and surrounding safety.

4.Acquisition of Location Information

  1. For the purpose of providing evacuation support functions, the App may acquire location information from the user’s device.

  2. Acquired location information shall not be used for the purpose of identifying any specific individual.

  3. The handling of location information shall be governed by the privacy policy separately established by the Laboratory.

5.Intellectual Property Rights

  1. Copyrights and all other intellectual property rights in and to the App, and to all programs, designs, text, images, charts, data, and any other information contained in the App, shall belong to the Laboratory or to third parties holding legitimate rights therein.

  2. Without the prior written or electronic consent of the Laboratory, users shall not reproduce, modify, repost, redistribute, publicly transmit, or engage in any similar act with respect to all or any part of the App.

6.Prohibited Acts

Users shall not engage in any of the following acts when using the App:

  1. Any act that interferes with the operation or provision of the App

  2. Any act that improperly exploits defects or vulnerabilities in the App

  3. Any act in violation of laws and regulations or public order and morals

  4. Any act that causes disadvantage or damage to the Laboratory or any third party

  5. Any act of analyzing or modifying the App by disassembly, decompilation, reverse engineering, or any other method

  6. Any act of using the App for commercial purposes without the permission of the Laboratory

  7. Any other act that the Laboratory deems inappropriate

7.Disclaimer

  1. With respect to the App, the Laboratory shall not be liable for any damage incurred by users, except in cases of willful misconduct or gross negligence on the part of the Laboratory. Where applicable law limits the scope of disclaimer, this Article shall apply only to the extent permitted by such law.

  2. Due to communication failures during disasters, power outages, device malfunctions, inaccuracies in location information, inaccuracies in map information, changes in road conditions or evacuation sites, or other circumstances, all or part of the App may fail to function properly, or delays, errors, or omissions may occur in the displayed content.

  3. The Laboratory does not guarantee the continuous provision of the App, the maintenance of any particular functions, or perfect compatibility with the user environment.

8.Modification, Suspension, and Termination of the Service

The Laboratory may, for research, operational, technical, or other reasons, change the content of the App, suspend its provision temporarily, or terminate its provision, without prior notice to users.

9.Amendment of the Terms

The Laboratory may amend these Terms as necessary. The amended Terms shall become effective from the time they are made known within the App, on a website, or by any other method deemed appropriate by the Laboratory.

10.Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.

  2. Any dispute arising between a user and the Laboratory in relation to the App or these Terms shall be subject to the exclusive jurisdiction in the first instance of the Tokyo District Court or the Tokyo Summary Court.
